GENERAL TERMS AND CONDITIONS
1. General
The following terms and conditions apply for all contracts, shipments and other services of „Bloodred Horizon Records“. Non-Compliance with the regulations of the contracting party all not allowed. Additional agreements require a written confirmation by us. At any time do we reserve the right to change or supplement these terms and conditions including all potential enclosures in a reasonable period of notice. Previous appointments will be processed at the still effective recent terms and conditions.
2. Order
The customer automatically accepts our terms and conditions when ordering. The amount has to be paid within 10 days when ordering prepayment. We reserve the right to resell the merchandise after the elapsed time of 10 days. We are not liable for any losses of remitted funds. We reserve the right to adjust incorrect prices due to typographic or pricing errors..
3. Payment Methods
We accept the following payment methods:
- Cash
- Bank transfer
- Cash On Delivery (C.O.D.)
- Paypal
- Credit Card
- Purchase Order (P.O.)
We accept the following credit cards: Visa, MasterCard & American Express. Pay on delivery is only possible for our Austrian customers. Starting with the 3rd purchase order, the term of payment for our Austrian and German customers is due within 14 days of receipt of invoice. All payment methods with the exception of „pay on delivery“ are advance payments.
4. Shipping
We only ship our products insured by our partners GLS, Hermes or the Austrian Post AG. The shipping partner will be chosen according to the cheapest rate of delivery at destination.
When ordering small amounts, the effectively accrued shipping costs can be billed to our customers. These costs can be obtained through us or the external page of „conditions of delivery“. Small orders will be processed only through the Austrian Post AG. We want to point out in particular that we assume no liability for damage or loss, if you explicitly order delivery through the Austrian Post AG without insurance. You can also pick between „Economy“or „Priority“ delivery, but we cannot provide warranty for a certain delivery period when choosing the option „Economy“. According to experience, delivery periods with „Economy“ can take up to 14 days. We therefore recommend a standardized parcel shipment.
In case the shipment has not arrived within an adequate time-period, please feel free to contact us. We will make further arrangements to find out about the whereabouts of the shipment. The delivered product is to be inspected immediately for damage upon arrival of the shipment. In case the delivered product shows any optical or acoustic defects (sound carrier), these defects have to be reported to us within 7 days of receipt . Further arrangements will be discussed individually. Normally, the damaged product is to be returned. After inspection of the damage, the item will be replaced or the payment returned.
5. Right of withdrawal
You are allowed to withdraw from your contractual statement within 14 days of receipt of the product without further explanation. This is to be done via text (letter, fax, E-mail) or by returning the item. The right of withdrawal does not apply, when the item was manufactured customer-specifically. (Paragraph 312 d Abs. 4 Nr 1 BGB). The beginning of the term is set when receiving the statement of the right of withdrawal. At this point, the item has had to be received by the customer already. It is sufficient to send a disclaimer or the items in time in order to observe the cancellation period. The disclaimer is to be send to the address in the heading. Unsealed sound carriers or already used clothes are exempt of the right of withdrawal.
6. Cancellation consequences
In case of an effective disclaimer, performed services of both parties have to be redeemed. If the client is not able to redeem the received service in total, or if the items are partially returned or show any signs of wear, the client is obliged to replace the value of the item accordingly. This is not the case if the signs of wear are due to testing of the item like it would have been possible when buying in a store. You are able to avoid an obligation for value replacement, if you handle the item carefully when first inspecting or trying. Thus you can avoid any damage or wear of the item, which could decrease its value. The client is obliged to return the items to us. The client has to bear any shipping costs when returning the item. Exempt are items, which are returned to us, if they have been damaged already upon arrival at the client.
7. Vis major
Delay of delivery or service due to acts of nature beyond control or events, which complicate or even hinder delivery or service, even if they occur with our subcontractors, release us to comply with a binding term for delivery. Such are for example: Problems with the sourcing of materials, disruption in operation, strike, official decree, lock-outs, fire- or water damage, trade embargo, natural disasters. In case of any of these events, we reserve the right to delay the time of service for a certain period of time.
8. Overdue fines
Costs, which might result from refusal of acceptance or an unsuccessful parcel delivery, will be charged to the client. We reserve the right to charge overdue fines for accounts that have not been settled in due time.
9. Retention of title
The received items stay the property of „Bloodred Horizon Records“ until full payment is received.
10. Storage of data
We want to point out that the data quoted in the appointment is digitally processed and stored. Personal data will be handled confidentially.
11. Legal notice
In case of intentional submission of incorrect data or when ordering for fun, we will file fraud charges. The address of the person who commits fraud will be detected via his IP-address, which is provided when placing an order by your „provider“. Consequently, the address will be forwarded to the office of the district attorney. Any additional costs, which emerge as a consequence of the fraud will be charged to the same person, who committed the fraud. Indicated or forbidden articles such as sound carriers or other items are not available at „Bloodred horizon records“.
12. Place of execution, place of jurisdiction, applied law
Austrian law applies. The UN Convention on Contracts for the International Sale of Goods does not apply. Our business location serves as place of execution for any disputes.
